Local Land Charges Search

The Local Land Charge section carries out all official searches covered by the Local Land Charges Act 1975, guaranteeing comprehensive replies to the official LLC1 and CON29 enquiries.

Houses and treesThe Law Society, which regulates solicitors, encourages the use of official searches and considers that alternative personal searches of the register, disclosing only limited information, should only be undertaken with the approval of the client. It is advisable to confirm that your solicitor has undertaken an official search and to inspect the Certificate of Search.

It is important to carry out a search when purchasing a property as a search is designed to inform prospective purchasers of, for instance, plans to build a new road in the vicinity, whether highways are public or privately maintained. Information regarding planning permissions/conditions, tree preservation orders, enforcement notices or housing grants and so on, which may affect the property to be purchased.

Each search involves research in respect of town planning, statutory orders, highways, housing and environmental health matters and is sent to the four separate Council service groups for their action. When Land Charges receive the required information the replies are collated and completed searches are usually returned within approximately five working days.

The search is in three parts:

  • LLC1 – The Official Certificate of Search Form, deals with all the registerable charges such as financial charges improvement grants, tree preservation orders, conditional planning consents and agreements.
  • CON 29R – The Enquiries of Local Authorities Form deals with issues such as road schemes, the planning history and various notices that affect the property. This questionnaire contains many ‘Warning Questions’, the answers to which you will not find on any of the statutory registers.
  • CON 29O - Optional enquiries including Question 22: Commons Registrations.

If you rely on a Personal Search from a solicitor or personal search company, may we remind you that you are not entitled to receive answers to the questions on the CON 29 form and any information obtained is not covered by Section 10(3) of the Local Land Charges Act 1975, which relates to compensation for loss. The only way to receive this information is to submit the official LLC1 and CON 29 forms.

Please note that searches must include the following when submitted to be accepted for processing:

  • A cheque made out to Bracknell Forest Borough Council for the correct amount.
  • Either an LLC1 form (search of the register) or LLC1 and CON 29 forms (full search)
  • The correct postal address together with an up-to-date scale plan in duplicate, showing the extent and location of the land to be searched, clearly outlined in red.
